Contractual Details

1. Scope of document

These Terms & Conditions are binding for all deliveries from British Shopping or Cornwall-Shop to consumers (§ 13 BGB).

A consumer is every natural person who closes a sales contract of their own free will that has neither relation to their commercial or self-employed working environments.

3. Offer and Sales Contract Closure

The products displayed in our online-shop do not represent a binding offer but are there to encourage you to place an order. We reserve the right to amend errors.

By clicking the button [BUY NOW!] your are entering into a binding order of the items listed on the screen. The sales contract is initialised when you receive an automatic email confirming receipt immediately after ordering.

4. Cancellation Policy

Return policy

You have the right to cancel your purchase within two weeks by written notice or –if you are already in possession of the goods - by returning them without stating any reasons for the cancellation. The period commences with the receipt of this caution but not before the receipt of the purchased goods. (in the case of a repeat delivery of goods, not before the receipt of the first partial delivery) and not before our commitments according to § 312 c Abs. 2 BGB i. V. m. § 1 Abs. 1, 2 und 4 BGB-Informationsverordnung (German Law) in addition to our commitments according to § 312 e Abs. 1 S. 1 BGB i. V. m. § 3 BGB-Informationsverordnung (German Law) have been satisfied. A punctual return of the goods to the following address:

is sufficient to secure your right of cancellation.

Consequences of cancellation
In the case of a cancellation, all received goods and benefits must be returned from both parties including all profit derived from its use (e.g. interest). If you are unable to return the received services and / or goods entirely or in part or only in a damaged or used condition, you will be liable to pay appropriate compensation. This regulation is only valid if the goods have been mishandled and/or subjected to inspection or usage in excess of normal “shop like” behaviour. Goods that can be returned by parcel post are to be sent to us at our risk. If the value of the returned goods does not exceed the value of 40,00 Euros or if the goods are of higher value and you have not paid any agreed instalments or repayments on the goods at the time of the cancellation, you are responsible for the postage charges incurred for the returned goods. In all other cases the postage is free of charge. Goods that cannot be returned by parcel post will be collected from you. Refunds must be transferred within a period of 30 days. This period commences with the dispatch of the returned goods and the date stamp on the receipt.

Cancellation is not valid for e-commerce orders:

  • bespoke orders that have been specially produced for the customer to his / her wishes.

  • When the goods are not suitable for transport or

  • Are highly perishable or

  • When the Shelf life has been exceeded.

  • Audio- and video- medium or software if the seal has been broken or tampered with

  • Newspapers, magazines, illustrations unless the consumer order has been accepted per telephone

 

4a. Cancellation – Shipping Costs

If the value of the returned goods does not exceed the value of 40,00 Euros or if the goods are of higher value and you have not paid any agreed instalments or repayments on the goods at the time of the cancellation, you are responsible for the postage charges incurred for the returned goods. In all other cases the postage is free of charge.
 

Prices and Shipping Costs

All prices include German VAT. We reserve the right to alter/correct prices of which you will be informed of by email. Please refer to the Delivery charges overview in the shop.

Further information regarding additional charges will be displayed on the shipping overview and in the product description page.

 

6. Delivery

Deliveries are shipped via Standard & Express Services.

 

Delivery deadlines are found on the on the product description page and the shipping overview.

 

Your order will be processed and normally delivered within 3 to 4 workdays. We will inform you by email should an article be temporarily or permanently unavailable. Products that are no longer available will voided and credited to you.
We reserve the right to partial delivery if an article is temporarily unavailable. No further delivery charges will incur for the completion of the order.

 

You are legally bound to accept delivery of the order. In the case that a delivery was unsuccessful due to incorrect or misleading information, we reserve the right to invoice the costs incurred for the return of the delivery. This is also applicable for not accepting delivery.

 

Although we thoroughly check all goods before carefully packing them, we require you to check your package and its contents immediately after receipt. Please inform us immediately if you should detect any obvious damage or discrepancies. Claims must be made within one week of receiving the parcel by telephone or email.

 

7. Payment

Payment is made on a advance payment basis, bank transfer, PayPal or per invoice (after your 3rd order with us) or Cash on Delivery. Payments per invoice must be made within 14 days of receiving your order.

 

A right to compensation is only accepted if your complaint has been recognised by a court of law or is indisputable or has been recognised and confirmed by us in writing.
 

You are only permitted to exercise the right of retention if the resulting claim is of the same contract.


Until full payment has been made, all goods remain the property of British Shopping.
In the case that one of these regulations should become void, this will not impede the effectiveness of the other regulations.

General Ordering Process

When you have chosen the product you wish you purchase you can place this in your shopping basket, without obligation, by clicking the button [add to basket] The content of your basket can be displayed by clicking on [show basket]. The products can be removed from your basket by clicking on [delete]. If you wish to purchase the items in your basket click on  [continue to your order]. Please enter the information requested. Mandatory input fields are marked with a “*”. Your data will be transferred via a secure channel. You will then be presented with the payments page where you will choose your preferred payment type. By clicking [continue to your order] you will be able check your order so far and modify if necessary. Finally, by clicking on [BUY NOW!] the sales process is completed. The process can be terminated at any time by closing your browser window. On the individual pages various options are displayed i.e. deletion, modification etc.

 

Contractural Details

The content of the sales contract will be stored on our internal systems. Our Terms & Conditions can be accessed from the main page of our online-shop at any time. If you have created an account, this can be accessed via the “Log In” screen. The data contained in your order will be sent to you via email. Due to security reasons this data will no longer be accessible via the internet.

 

Privacy Policy

We are very please that you have decided to visit our web site. The protection of your privacy is very important to us. We wish to inform you how we treat your information submitted to us.

Storage, Processing and Usage

You can visit our site without entering any personal data. We only store data related to how you accessed our site (Name of provider, the page from where you came or the name of the data you requested) that is not related to your person. This data is only processed in order for us to improve our services, without allowing any relationship to your person.

Personal data is only requested for the purpose of processing an order or opening an account or voluntary registration for our newsletter. We use your data, without requesting any further permission, only to complete your order. After successful completion and payment your data is secured and archived for the obligatory period as defined by German Laws. After this period your data will be deleted unless you have given us permission to withhold it and process it further. If you decide to register for our newsletter, your email address and your permission to use your data for our own advertising campaigns will be implemented until you decide to revoke your registration. You can revoke your registration at any given time.

Cookies
We require to use cookies on different pages on our site in order to present our site in a more attractive manner and also to implement additional functionality. These are small text files that are stored on the hard disk on your PC. Most of them are deleted immediately after the Browser Session has been terminated others remain present in order for us to recognise you when visit us again and enable us to greet you with your name and save you entering the same information i.e. user name, password or forms each time you visit us.

Data Distribution

Your data will only be given to our shipping contractors if this necessary to deliver goods or to Bank/Clearing Institutes for the completion of payment transactions.

 

Right of Information

According to German Law you have the right to request insight to your data stored by us and furthermore the right to correction, inactivation or deletion of this data.. This is free of charge.
